1. Acceptance
If you do not agree to these Terms, do not use the Service. By creating an account, clicking accept, or using the Service, you confirm that you are at least 18 years old and have authority to bind yourself or the organization you represent.
2. The Service
HireDesk AI is an AI-assisted hiring productivity tool that helps generate and analyze hiring-related materials (for example job descriptions, CV screening, interview questions, offer letters, rejection emails, LinkedIn posts, onboarding checklists, and related outputs). The Service uses third-party AI providers (such as Anthropic Claude). Features and availability may change over time.
3. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
4. Subscriptions and fees
- We offer Free, Pro, and Business subscription tiers as described on our Pricing page. Fees, taxes, and billing cycles are as shown at checkout or in your billing portal.
- Paid subscriptions are billed through our payment processor (Stripe). By subscribing, you authorize recurring charges until you cancel in accordance with these Terms.
- Pro and Business subscriptions begin immediately upon payment. No free trial is offered.
- Subscription fees are generally non-refundable except where required by law or expressly stated at purchase. Downgrades or cancellations take effect at the end of the current billing period unless otherwise noted in the product.
- We may change pricing or plans with reasonable advance notice; continued use after the effective date constitutes acceptance unless you cancel before the change applies.
5. Acceptable use
You agree not to:
- Use the Service in violation of law or to engage in unlawful discrimination.
- Submit content you do not have rights to use, including candidate data without a lawful basis.
- Attempt to probe, scan, reverse engineer, or circumvent security or usage limits.
- Use the Service to develop a competing model or scrape outputs at scale.
- Misrepresent AI-generated content as human-created where that would be deceptive.
- Use the Service to harass, threaten, or harm individuals or to process illegal biometrics or sensitive categories of data without proper authorization.
6. AI outputs and professional advice
Outputs are generated by AI and may be inaccurate, incomplete, or unsuitable for your situation. The Service does not provide legal, employment, or HR advice. You are solely responsible for reviewing, editing, and using any output, including compliance with employment laws, anti-discrimination rules, privacy laws, and your internal policies. Always have qualified counsel review binding documents such as offer letters before use.
7. Your content and license
You retain ownership of materials you submit ("Your Content"). You grant Cognitech Insights a worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate, secure, and improve the Service (including using trusted subprocessors). Subject to these Terms and our intellectual property rights in the Service itself, you may use outputs generated for you in your hiring and business operations.
8. Candidate and third-party data
If you upload resumes, applications, or other personal information about candidates or employees, you represent that you have a lawful basis to do so and will comply with applicable privacy laws. Do not submit special categories of personal data unless you are legally permitted and have obtained any required consent.
9. Privacy
Our Privacy Policy describes how we collect and use personal information. By using the Service, you agree to that policy.
10. Intellectual property
The Service, including software, branding, and documentation, is owned by Cognitech Insights or its licensors. Except for the rights expressly granted here, no rights are transferred to you.
11. Third-party services
The Service relies on third parties (for example hosting, authentication, payments, and AI providers). Their terms and policies may apply to their respective services.
12. Termination
You may stop using the Service or close your account subject to billing terms. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we discontinue the Service with reasonable notice where practicable.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, COGNITECH INSIGHTS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COGNITECH INSIGHTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT ALLOWED BY LAW.
15. Indemnity
You will defend and indemnify Cognitech Insights and its officers, members, and employees against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.
16. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. You agree that exclusive jurisdiction and venue for any dispute arising out of these Terms or the Service lies in the state or federal courts located in Tarrant County, Texas, and you consent to personal jurisdiction there.
17. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will provide reasonable notice (for example by email or an in-product notice) at least fourteen (14) days before the effective date when practicable. Your continued use after the effective date constitutes acceptance of the updated Terms.
18. General
- These Terms constitute the entire agreement between you and Cognitech Insights regarding the Service.
- If any provision is unenforceable, the remainder stays in effect.
- Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
- Government users: the Service is commercial computer software under applicable FAR and DFARS clauses where relevant.
